TERMS OF SERVICE

Agreement Overview

By creating a FlexDrivv account, submitting application records, and activating a vehicle subscription plan, you enter into a legally binding agreement governed by these Terms of Service.

1. Subscriber Eligibility

To be eligible for a vehicle subscription, all primary drivers must satisfy the following criteria:

  • Must be at least 21 years of age at the time of enrollment.
  • Must possess a valid, non-provisional driver's license (issued within the US or an official international translation/permit).
  • Must pass our background security and driving record audit (no major moving violations, DUIs, or reckless driving incidents within the past 3 years).
  • Must supply a valid Social Security Number (SSN) or ITIN for soft credit checks.

2. Payments, Billing & Cancellation

Our subscription structure operates on a month-to-month flexible cycle:

  • Billing Cycle: Subscriptions are billed in advance on a recurring monthly date based on your original vehicle pickup.
  • Upfront Fees: A one-time enrollment fee is charged upon verification. There are no down payments or security deposits.
  • 7-Day Cancellation Window: You can pause or cancel your subscription at any time. To prevent subsequent cycle charges, cancellation requests must be requested at least 7 days before your next renewal date.
  • Late Payments: Unresolved payments will trigger automated vehicle tracking and immediate suspension of subscription privileges.

3. Vehicle Swaps & Fair Usage

Vehicle swaps are governed by your subscription tier level:

  • Premium and Ultimate members receive up to 2 complimentary swaps per calendar month within their tier. Additional swaps incur a flat $150 logistics fee.
  • Pro-rated billing applies immediately if upgrading or downgrading tiers for specific swap periods.
  • Smoking, vaping, or pet transport (without approved secure carriers) inside any vehicle is strictly prohibited. Violating this rule will result in a $250 cleaning fee.

4. Insurance Coverage & Liabilities

All active subscriptions include comprehensive commercial insurance underwritten by GEICO:

  • The standard subscription tier carries a $2,500 collision and comprehensive damage deductible.
  • Members who upgrade to our Zero Deductible plan ($25/month) carry $0 liability for collision damages, provided all safety guidelines were strictly adhered to.
  • Only the primary verified subscriber is covered under GEICO policies. Permitting an unauthorized driver to operate the vehicle voids all insurance coverage and constitutes a breach of contract.

5. Proactive Maintenance & Damage Reporting

Routine scheduled maintenance, fluid checks, tire rotations, and repairs are 100% covered by FlexDrivv:

  • Subscribers must pull over safely and contact our Dispatch Desk immediately at +1 (800) 555-3748 if any warning indicators trigger on the dashboard.
  • Traffic violations, parking tickets, and local toll charges incurred during your usage window are the sole responsibility of the subscriber. Toll charges are billed directly to your payment method on file.
